Odds of being released? Eh...

However, even with a legal green light, Fallout Online faces many obstacles on the road to release--foremost of which is Interplay's shaky financial state. In a financial report released last year, the company reported a loss of $1.052 million on $854,000 of income for the nine months ending September 30, 2009, thanks mostly to $1.48 million in "general and administrative" costs. During that same period, the company reported it had only spent $195,000 on product development.

I wonder what can explain that situation (I mean the high administrative cost & low development budget)

I would at first expect a development budget to be at least 50% of overall yearly budget for a gaming company the rest being split between administrative, general & publicity but then I'm no gaming company manager

still seems very disproportionate ...

Now, according to legal documents obtained by industry site Gamasutra, the legal battle between the two companies has re-erupted. On November 19, Bethesda said Interplay's use of the aforementioned Fallout assets was a violation of the two companies' trademark license agreement, an assertion Interplay contested in its own filing on December 3.

You know what, they maybe cutting cost by using art from the other fallout games. This would lighten the load tremendously.

According to a press release describing the settlement, the "license granted to Interplay to develop a Fallout MMO is null and void."
